I understand that the travel services provided by Aum Journeys LLC are expressly conditioned upon the full satisfaction of these terms and conditions. By paying the Trip Planning Fee, I am hereby agreeing, on my own behalf and on behalf of those in my travel party, to the following:
Pricing/Payment
Any failure to pay in the amount or timeframe indicated on an Invoice may result in termination, forfeiture, lost bookings, late fees, or changes to travel dates and available accommodations. I agree to pay all fees and amounts, in full, and when due, including, but not limited to:
- Trip Planning Fee: This non-refundable fee goes directly to Aum Journeys LLC upon completion of the Initial Consultation. It compensates Aum Journeys LLC for time spent researching, pricing, and providing on-site support before, during, and after travel. This fee also covers:
(i) marginal edits and revisions to the Travel Plan which are requested after the Initial Consultation, but prior to the Initial Deposit due date;
(ii) prompt service and availability – all emails are acknowledged and replied to within 2 business days;
(iii) use of a personalized itinerary app and/or hardcopy travel/voucher documents;
(iv) individually catered recommendations and in-destination support; and
(v) emergency contact services. - Pricing/Quoting: Aum Journeys LLC protects their in-destination travel suppliers’ contract rates by providing all quotes as a total package price. I understand that I’ll receive all pricing as a bundled rate and will not be provided with component/ itemized pricing.
- Initial Deposit: This amount becomes due after the completion of the Travel Plan and is used to reserve transport, hotel bookings, and other travel accommodations. In the event of a cancellation, postponement, delay, or failure to be abide by these terms and conditions, the return of the Initial Deposit shall be subject to the guidelines and policies of various service providers, suppliers, and/or venues and return in-full or in-part cannot be guaranteed.
- Final Payment: The Final Payment is due as stated in the corresponding Invoice (typically 30 – 60 days prior to departure). This amount is used to pay, in full, the remaining amounts required by the travel and service providers, suppliers, and/or venues to secure the travel plans in accordance with the customized itinerary. As stated above, once received this amount becomes subject to the guidelines and policies of the aforesaid providers and return or reimbursement is not guaranteed.
- Change Orders/Out of Pocket Expenses: In the event that numerous and/or significant changes to the itinerary are requested (in excess of that agreed to in the initial Travel Plan), additional charges may be required (at the discretion of Aum Journeys LLC) to compensate for the added time and expenses of accommodation. Revisions typically considered as significant include: four or more changes to the Travel Plan, re-pricing and availability checks required due to failure to pay the Initial Deposit within 60 days receipt, new destinations, new travel dates, etc. Aum Journeys LLC shall be reimbursed any and all out of pocket expenses which I have expressly agreed to pay, including increased fuel charges or governmental fees. Aum Journeys LLC shall be entitled to reimbursement for sums due and owing on an Invoice or otherwise due as a result of credit card cancellation or returned check. Aum Journeys LLC’s right to reimbursement shall extend to include all costs of collection (reasonable attorneys’ fees, court costs, etc.).
Client Responsibilities
I acknowledge that Aum Journeys LLC is acting an intermediary/booking agent between my travel party and principal service providers such as cruise lines, hotels, airlines, and resorts. Each of these suppliers acts as an independent entity outside of the control of Aum Journeys LLC. In connection with my travel plans, my travel party remains responsible for arriving on-time, confirming arrival and departure times, following service provider instructions, policies, and guidelines, as well as adhering to all applicable laws, statutes, customs regulations, and other instructions, including, but not limited to the following client responsibilities:
- Travel Insurance. Travel protection and insurance is strongly recommended. Unless specifically noted, procurement of travel insurance is not included as a service of Aum Journeys LLC. Information regarding travel insurance shall be sent upon request. Penalties may apply for changes or cancellations to this trip and may also vary depending on cancellation conditions and availability of travel insurance.
- International Travel. For all international travels, a US Passport (valid at least 6 months beyond the return date of the trip) is required. If I am traveling internationally and am not a U.S. citizen, I am responsible for having the correct documentation needed to travel to and from all countries visited during my trip. It is my responsibility to check for any special documentation, requirements, restrictions, and/or visas required for my trip. Immigration and customs requirements are solely my responsibility (e.g. – for travel to Canada, persons with records that include felony convictions, driving while intoxicated, misdemeanors, or other offenses may be denied entrance).
- Documentation. My name as listed on the initial Invoice appears EXACTLY as shown on the government-issued photo identification that I will be using during my trip. If I fail to notify Aum Journeys LLC of any name discrepancies within 24 hours’ receipt of the initial Invoice, penalties may apply as a result of the changes required to enable travel. I am responsible for any and all charges or penalties incurred as a result of lack of proper travel documentation. Aum Journeys LLC is not responsible for any delays, damages, or losses, including missed portions of trips or denied boarding or entry as a result of improper travel documentation or other third party error.
- Minors. For travel with minors, notarized consent letters are required if less than all parents and/or legal guardians will be attending the trip and international travel is involved. It is my responsibility to ensure I have the proper documentation for travelling with minors.
- Service Provider Policies. Size and weight restrictions for luggage on airplanes and all other transportation during a trip is my responsibility. Aum Journeys LLC is not responsible for luggage costs for excessive weight/size/quantity during my trip. I shall be responsible for any fee for carry-on and/or checked luggage charged in connection with my trip (note, this fee is typically to be paid upon check-in for the flight and is not included in Aum Journeys LLC’s calculation of ticket prices). Visit the airline, tour company, or cruise line website directly for specific luggage limitations and information. I agree to re-confirm my flights within 24 hours of departure for domestic and 72 hours for international, as times, aircrafts, and seat assignments may change after the initial booking.
Disclaimer
Aum Journeys LLC shall not be responsible for liability for any accident, illness, adverse health condition, property damage, personal loss, or other casualty in connection with any of the travel services provided hereunder, regardless of weather conditions, natural disasters, pandemics, acts of God or governments, civil unrest, strikes, riots, breakdown in equipment, theft, delay, changes in fuel cost, or any willful or negligent act of any traveler. Aum Journeys LLC reserves the right to terminate its provision of services at any time if it deems that there is no longer a mutually beneficial, working relationship. Aum Journeys LLC shall endeavor to provide all pricing breakdowns upon request; however, due to confidential contracts between suppliers and travel providers such as hotels, airlines, transportation companies, and tour providers, price breakdowns are not always available for packages that include multiple trip components. Aum Journeys LLC is not responsible for the actions of travel suppliers such as breach of contract, or failure to comply with the ADA or other applicable regulation. Any refunds as a result of trip issues or undelivered services are to be resolved with the travel/service supplier and are not the responsibility of Aum Journeys LLC. Aum Journeys LLC reserves the right to use any photography or other media taken at any travel activity without express written permission; notice must be given to Aum Journeys LLC if such use is not authorized. By offering for sale travel to particular destinations, Aum Journeys LLC does not represent or warrant that travel to such locations is advisable or without risk, and shall not be liable for costs, damages, or losses that may result from travel to such destinations. My participation constitutes acceptance of such events at my own risk.
Miscellaneous
I have the full legal capacity to be bound by these Terms and Conditions. This is the entire agreement between the parties and there are no other oral or written agreements or representations between the parties except as expressed herein. These Terms and Conditions shall not be modified unless agreed in writing. While Aum Journeys LLC strives to provide finely catered and highly individualized services, personal satisfaction and experiences may vary on an individual basis. No material from this website may be modified, reproduced, republished, posted, transmitted, licensed, used to make a derivative work, sold or otherwise distributed in any way, without the prior written consent of Aum Journeys LLC. This agreement shall be governed by the laws of the State of Michigan. If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect. All rights not granted herein shall remain reserved.
